AAIS FARMOWNERS PROGRAM: GL-78–FRUIT OR VEGETABLE PICKING–BY PUBLIC–HORSE BOARDING OPERATIONS

INTRODUCTION

This endorsement can be added to policies that include either farm personal liability or commercial liability coverage. It covers the liability that results or arises from farms that do either or both of the following:

·         Permit the public to pick fruits or vegetables

·         Board (house) horses that belong to members of the general public

ENDORSEMENT SCHEDULE

Fruit or Vegetable Picking–By the Public

This part of the endorsement schedule has spaces to describe the operation, list the location, and enter the operation’s estimated receipts.

 

Example: The Tannerville family went to pick apples at Red Gems Orchard. Bobby, their five year old son, was so excited that he got out of the car and started running to the nearest trees as soon as the car stopped. A car leaving the Orchard’s parking area hit him. The Tannervilles sued Red Gems for the substantial cost of Bobby’s surgery and extended rehabilitation.

 

Note: This endorsement does not state the basis for the receipts (gross or net) or the time period for the receipts (monthly, seasonal, annual, etc.).

Horse Boarding Operations

This part of the schedule has spaces to describe the operation, list the location, and enter the estimated number of horses boarded.

Note: This endorsement does not state the maximum capacity or the average number of horses boarded. As a result, questions could arise about the consequences of the number of horses actually boarded being different than the number on the endorsement schedule.

COVERAGE

This endorsement extends the coverage that either Personal Liability Coverage (Farm) or Commercial Liability Coverage (Farm Premises and Operations) provides to the operations on the endorsement schedule as follows:

1. Fruit or Vegetable Picking–By the Public

Coverage does not apply to bodily injury or property damage that results from using ladders or picking product off the ground in any way unless there is a check in the box on the endorsement schedule that permits these activities.

2. Horse Boarding Operations

Coverage for bodily injury or property damage applies, but only if it occurs on the insured premises or results from a boarded horse escaping from the insured premises.
